Credit card and payment processing is handled by third-party service providers. Billing Information cannot be kept, used, or stored by these service providers for any other reason than to process credit cards and payments on our behalf. We use transport layer security (TLS) technology to encrypt the transmission of your payment information when you enter it for processing by our third-party service providers. We do not keep this information on our systems.
But it’s important to keep in mind that no system can ever ensure complete security. Therefore, we are unable to guarantee the security of information stored on, sent to, or received from our services. Unauthorised access to our servers and systems is not something for which we are liable or responsible. You should be aware that any time you disclose any personal or protected health information, it could be accessed by anyone and could then be obtained and used without your permission. 12. HIPAA
PHI that you or your healthcare provider sends to us or that we receive from your healthcare provider may be collected, disclosed, used, and stored by our websites and services. HIPAA regulates our PHI acquisition, disclosure, use, and storage.
12.1 How Your Protected Health Information Is Used and Disclosed
Your PHI is used and disclosed by us as a Business Associate, as defined by HIPAA, when you use specific services (for instance, an appointment request), in accordance with the terms of the Business Associate Agreement between us and your healthcare provider. Therefore, we are only permitted to use and disclose your PHI in accordance with the terms of the Business Associate Agreement on behalf of, or to provide services to, your healthcare provider. This restriction on use and disclosure is subject to some exceptions. In accordance with these exceptions, we may use and disclose your PHI (i) for our internal management and administration (ii) to comply with legal obligations, and (iii) to perform data aggregation services for your healthcare provider and other healthcare providers; provided, however, that any disclosures for our internal management and administration (IM&A) or to comply with legal obligations are either required by law or made after we obtain reasonable assurances from the party to whom the PHI will be disclosed.
Some of our services might be outsourced. In order to do this, we demand that our subcontractors abide by the same PHI terms and conditions that are applicable to us as a Business Associate.
We might be permitted to de-identify your PHI as a Business Associate. According to the HIPAA-mandated standards, we de-identify PHI. Under the terms of this privacy statement, we may use and disclose any such de-identified information in the same manner as personal information.
No rights under this privacy policy, HIPAA, or any other law or regulation are granted to you by this section.
12.2 How to Access, Modify, or Remove Your PHI
HIPAA establishes rights with regard to your PHI, with some exceptions. These rights typically include the ability to limit how your PHI is used and disclosed, the ability to view and obtain a copy of your PHI, the ability to amend your PHI, and the ability to request an accounting of PHI disclosures. Please get in touch with your healthcare provider if you wish to make use of any of these rights.
Please be aware that you are not permitted to look at another user’s account’s content. As a result, you might not have the right to access, update, or delete the personal information that you shared with another user or third party using our sites and services. Please be aware that other users may submit information about you that can be used to identify you, and you might not have the right to access, edit, or delete that information. In either case, HIPAA and other relevant laws or regulations may require some users, like healthcare providers, to retain such information for a long time.
The majority of our business associate agreements mandate that upon termination of the business associate relationship, we and our subcontractors must either return or destroy any PHI acquired or generated in accordance with the business associate relationship. Therefore, any PHI that you provided to our sites and services or that is otherwise kept by us or a subcontractor in connection with our sites and services will either be returned to the healthcare provider or destroyed by us or such subcontractor if the Business Associate Agreement between us and your healthcare provider has been terminated.
13. Minors’ and Children’s Privacy
Our websites and services are not intended for use by anyone under the age of 13. We do not knowingly collect personal information from children under the age of 13 or use plug-ins or ad networks that do so through websites or online services operated by third parties with a clear child-directed audience. When we become aware that we have gathered personal data from a child under 13, we will take steps to immediately delete that data.
Users of our sites and services must typically be at least 18 years old. Our websites and services never ask users under the age of 18 for their age unless they also include the “Privacy Rights for California Minors in the Digital World” supplemental terms. Without limiting the generality of the aforementioned, our services may permit users older than 18 (such as healthcare professionals, parents, and guardians) to submit personal data of minors. These users fully accept responsibility for how they submit, use, and transmit such information.
14. Users from abroad
We have our main office in the US. Our websites and services are targeted at American users and are hosted and managed there, or they are hosted by cloud service providers with offices both domestically and abroad. If you reside outside of the US, please be aware that any information you give us or that we acquire as a result of your use of our sites and services may be processed, transferred, and stored in the US as well as any other nations where our cloud service providers have operations. Please be aware that certain countries may have different privacy standards and laws than the country in which you currently reside. You agree that we may transfer your information to the United States and any other nation where our cloud service providers have operations for processing and storing if you use our sites and services or provide it to us.
15. Rights to Privacy
The California Consumer Protection Act, the California Privacy Rights Act, and the Virginia Consumer Data Protection Act (collectively, “Applicable Data Privacy Laws”) are some of the applicable U.S. data privacy laws and regulations that this section is intended to comply with. Only users who live in states, commonwealths, or territories with applicable data privacy laws are covered by this section.

- information about a career or employment; and
- conclusions made about users based on any of the data mentioned in this section, including preferences, traits, psychological tendencies, predispositions, behaviour, attitudes, intelligence, abilities, and aptitudes.In accordance with the Virginia Consumer Data Protection Act’s (“VCDPA”) definition of “decisions that produce legal or similarly significant effects,” profiles are not used to support such decisions.

15.6 Personal Information Retention
